CalGal - My neighbors and I wash our cars in our driveways. Some of our neighbors cars, when parked in their driveway, hang over into the street. I don't mind. After all, we are <b>the renters</b>.<p>

It just occured to me; you never see General Lyon's car parked in his driveway.

The size of a legal driveway is specified by code and the laws are consistent throughout the county. How each HOA deals with infractions may vary but the Rules and Regs will usually have the steps taken such as warnings and towing. If a person already has one warning I would think they would research the rules to make sure they weren't violated again.



As a landlord I provide a copy of the CCR's, Rules and Regs, especially parking rules, to my tenants and have them sign for them. If they violate them I am still the one on the hook so I make them vary clear including parking passes which I charge $100.00 deposit for.



Like I said if you live in one of those enviornments then you expose yourself to those events.



As far as not reading and understanding the documents I think most people on this forum are certainly smart enough to read and fully comprehend them.



Life is complicated and real estate is extreamly complicated.



The last HOA I was a member of was 20 years old working with outdated documents and was terrible. It had nothing to do with the builder but more the reality of human nature. Members rarely act in the "community interest" but try to further their own interest.



I can say that I read every document involved and if I have any questions I get them clarified by either the management company in writing or pay an attorney to explain the areas of interest. That is the responsibility of the buyer.



I have passed on properties based on limits on time allowed for garage doors being open, parking rules, and reserve studies.



Sometimes we have to take responsibility for our actions and move on.

Nope, no city cops in unincorporated Santa Ana. You get the protection of the County Sheriff. I'm not sure that's better, honestly.
 
Contact Lennar and threaten to go to the local newspapers if immediate changes arent made. With the lack of home sales and negative exposure this will get them motivated to work with current owners.



Towing is not neccesary, a small fine would be more appropriatte. Complain until you talk to the CEO of the company.



Not all HOAs are this ridiculous.
 
Where I live, all my neighbors park their vehicles along streets with signs stating, "No Parking anytime." Yet, for 3 years, I have not seen a tow truck.

<p>jcaraway...fyi, we can't tow a vehicle on private property. You would have to call a tow truck yourself, or contact your HOA to do so. We can only tow on public streets/areas.</p>
 
Troop, i contacted my old HOA many times to request them to tow, however, they always defaulted to the police or the tow company. Cops and the tow company always said they couldn't touch the vehicle or even provide a warning. Guess the HOA was telling me to shove it.
 
When someone doesn't actually live in the community (builder, etc) its very easy for them to tell us that the situation sucks, but can't be helped. There are well meaning homeowners on the board but unless there is a majority there really isn't much we can do.



What we MUST have happen:

1) Use local police to patrol speed and parking. I'd rather fight city hall than Patrol One.

2) Use a local impound lot (they say they will look into it. we'll have to see)

3) Implement a non psycho decal system. I can tell you for sure that 24 hour towaways of unsuspecting visitors isn't good PR for our fine community. I'll try to have my inputs on this system.
