...and i've read through the assessor and ttc websites many times. obviously there's somehting that i'm not completely understanding and my mortgage servicer is not explaining it to me when i call.

Who is your servicer? Do you still have your loan documents?



How much did you pay for your unit?



What is your loan rate and orginal balance?



I've heard unfortunate stories about impound accounts before. The servicer can screw up and not collect the impounds or forget to pay the impounds, etc and you are liable not them. Sometimes, because the loans changes hands so many times errors happen. Once they catch the error the loan servicer is going to try and collect from you.



I'm not sure if that is the case with you. The answer probably lies in your original loan documents and/or the tax assessor office. Maybe ask the loan servicer to put the explanation in writing so you can show it to someone that understands their language.
 
that sounds like something similar what happened to my cousin. The servicer was paying the incorrect property tax amount and he received a penalty from the county. The servicer admitted their mistake and paid the late fees and interest that was owed the county.
 
myfirsthome, I had the exact same problem where the my servicer (Chase) stated that I owed an additional $10K plus per month for my monthly tax bill. Not sure what the error was but it looks like i was being assessed for the prop taxes for my entire phase.



I only fixed the problem by calling at the servicer over the course of a month to remove my impound account. Eventually they did, but I really had to spell it out for them. I suggest you don't let them "research the problem". Just ask for a supervisor and start grinding away at them to get your impound account removed. On their side, it's as simple as clicking a button on their computer.

I had a neighbor (who has since walked away) who had a couple different tenants (at different times) renting the first floor bedroom. We both have Plan 3s, so I was very curious as to how much rent he was getting for this small bedroom (even though there's no way I could convince the wife to rent our guest bedroom). He claimed to rent that room, shared 2nd floor area, and a garage spot for $800. That sounds high to me - I'm just reporting what I've heard.



There's either something wrong with the impounding, or there was something very wrong with the original calcs. Either way, you're being wronged. Were the taxes being impounded initially close to 1.8% of your purchase price? That should be sufficient. The only tax change should have been a decrease, considering values haven't increased.

also, seems like the rental rate is actually closer to $750-800 for the downstairs room w/attached bathroom. i was originally charging $750 + actual utilities so is it completely unfair to ask for an increase in rent? how does that stack up to an IAC place?

just wanted to post an update: been working with Chase since last week (got transferred 6 times in one call) and they claim that my tax rate has doubled since purchasing in 2007. has anyone else seen this increase? my mortgage insurance hasn't changed and the p&i payment hasnt changed. they recommended filing for a "shortage spread increase" which would take my impound shortage and recalculate the "extra" payment amounts to spread across 24 months rather than 12. they also recommended writing in to request that the impound account be removed completely. supposedly the review process takes about 2 weeks and although it's unlikely they'll remove it, it's worth a shot. i'm currently working with the OC treasurer/tax collectors office to review my tax bills.



if anyone wants information based on my experience (direct phone #s for Chase and the fax # to request waivers/exemptions) please don't hesitate to PM me.

Well, the sales office trailer is now gone. They're digging the area up in preparation for foundations. This is the final phase (buildout) of Camden Place.

edit: I think its just coincidence though.
 
I have heard some of those newer developments were offering special incentives at one time where they will pay all or part of your mello roos for a period of time such as a year or two. Not sure that is what happened in your case but you should review your original documents for this 'incentive'.
