Is it possible for a group of homes to defect from the HOA?

He's been obsessing on me in strange ways lately. It looks like you got caught up in the backdraft.
 
Your management company will have a copy of your HOA's CC&R documents, which will answer your questions with more authority than a bunch of strangers on the internet.

I was just reframing the statement to more accurately describe our disagreement.

I want (the opposite of what you want).



OP wants to leave the HOA.

Everyone has unreasonble expectations that will never be realized. For example, I always wanted to be a competitive long distance runner.

It would probably be easier, and you would probably be better off if you and your 12 neighbors tried to get involved in the current board rather than defect and form a new HOA. In any case, before you try and defect and form a new splinter HOA, you would need to find out what is in the CCRs and find out where the money goes today.



So you have to get a copy of the CCRs and involved in your current board in any case. I'd start there.

Does the $165/month include exterior repair/maintenance reserves, fire insurance, liability insurance, etc.?



My parents lived in a town home in Buena Park for about 10 years. We've always wondered what the $120 HOA fee was for (other than weekly landscaping) until the painters and roofers came to repaint exterior walls and replace all roof tiles. Oh and the community's streets and guest parking area was re-surfaced (tared?).



When I lived in Placentia, the HOA sent cleaning crews to pressure wash exterior walls and wiped some windows. I was wondering why all the units looked "clean" outside when I bought the place.</blockquote>


no, it's all single family homes so we pay for our own insurance, water etc. i'm sure if the street developed a pothole they would take care of it. we also take care of our own landscaping. it's only the gates, and i'm assuming the insurance for the gate. my bill always says there is a monthly meeting but nobody ever shows up. also calls to the mgmt company are never returned for example: the last homes sold 6 months ago and they haven't coded the gate and the for sale flags are still all over the place.



i'm just thinking that if i can table enough signatures for a vote, there can be a vote about dividing up the community. the consensus in the community is to get rid of the gate and get rid of the HOA.
 
Have you considered meeting with other home owners in the entire HOA and discuss getting an "active" board, as well as a NEW management company? For $165/month, you should be getting more.
