IAC Raising Lease Break Fee

It does seem that everywhere in Irvine has ants. I've battled them over the years. I'd venture to say that the stores that sell ant spray do pretty well here in Irvine.
 
i am still scratching my head over jcaraway's initial response but he hit on a good point. you can spray the hell out of your place but if your neighbors are filthy bastards you're going to battling bugs no matter what. preventative measures, i.e. having the outside sprayed regularly is vital so you should find out what how or if the complex does that regularly or only calls when ppl request it indoors. it's got to be a group effort.



one summer ants got into my PB capt'n crunch in the pantry. the entire pantry was crawling with them. i relegated myself to signing a terminix contract even though i always thought it was unnecessary. although the assoc would spray the outside landscaped areas (this is when i was living in a detached condo), i still have terminix come to spray the garage, patio, and specifically all the areas directly along house. i asked about toxicity and they said these days the stuff they spray is less toxic than the flea medications people put on their pets. there's no fumes whatsoever and i leave the house for about 15-20 minutes but even that is totally optional. i get the inside done only once a yr because it's a pain to clear out all the cupboards and pantry, plus regardless of how harmless they claim the stuff is, i'd rather not have it done inside too much. once a yr -- that's it! but every quarter or so i will have the outside done. i've never seen ants inside the house since.



these days in shady canyon it's not so much of a problem because i'm further removed from the rest of the filthy plebes of irvine.

I know quite a few people who are in danger of losing their jobs and the lease break fee, even if not entirely collectible, is a pretty crappy tactic to try and keep people in their apartments. Talk about piling on! I think IAC should waive all lease penalties if a resident can prove that they were just laid off.
 
Well this thread is MANDATORY reading for all of you re-signing your IAC Lease.



Yesterday I spent a few minutes with my IAC Leasing consultant. I had with me last years

signed lease with the amendment showing the Lease break fee at $ 1800.00



After him going to the manager we agreed on a 1 year lease. Since I have been a tenant for almost 2 years

and the market for my apartment is lower on the Internet than what my existing lease was we agreed

on a lower rent. As a matter of fact $ 110.00 less per month for my one bedroom.

I also presented them with the IAC policy that was posted about rent discounts that begin with 2 years

of continued occupancy in good standing. I am short a couple of months those 2 years.



The leasing agent seemed anxious for me to agree with these terms. I asked him exactly the following statement.



"Will there be any other changes to the existing lease or any further amendments or changes?"

His exact response was "no". Just a 1 Year lease at the new rate. We shook hands and said we had an agreement.

I told him to draw up the lease renewal and leave it in my door and I would sign it and return it.



Well low and behold. The new lease has changed the lease break fee to $ 3600.00. Doubling it.

Classic "Bait and Switch" So thanks as always to my IHB brothers for bringing this IAC "scam" to everyones attention.



Oh I am sure its just an oversight and will be changed.

But if its not I am going up the IAC chain of command on this one.



SO ALL IAC RENTERS BEWARE ! READ YOUR LEASE !!!!!!!

hmmm, I wonder if you'll get a concession out of this. Pretty serious oversight, I think. Keep us updated!
 
Well, my lease is not up yet, but because of this thread I will look for alternatives early - just in case. Btw. I did not know about the discounts for people who already live in these apartments for a long time. Even though they say "you don't have to do anything, everything will be considered automatically", I talk with them about that policy when the renewal comes up and the lease break fee is acceptable.



Well, the ants... I dealt with them multiple times already. Even if you keep everything perfectly clean you still have to deal with the "scouts" which explore the area for food. I figured that it is actually best if you see an outbreak happen once and figure out exactly where the come from. Then just spray that spot and like 4 inches around with AntRaid and the problem is resolved - at least it worked in my apartment.

My Leasing Consultant kept the copy I showed him yesterday. Especially since I asked him about this schedule in

our previous conversation last week.



I may call my attorney in the morning and get his advice before I take this matter further with IAC.

He does owe me a few favors now that I think about it.

btw, got my survey in my inbox yesterday. Already formulating my choice comments. Don't get me wrong, there are a lot of things that I love about my apartment, but there is also much to be desired (parking is the dumps, for example).
 
Well I just got off the phone with the IAC Leasing Consultant.



His response was. Oh thats what "They" want now. In regards to the

doubling of my Lease Break Fees.



I reminded him about our conversation and negotiation the previos day

and how I implicitly asked. "Any other changes to the lease or amendments? " and reminded him

that he said "No". I asked "dont you feel the doubling of this fee is a change that I should have been

told about in our original negotiation ?



He seemed befuddled.

I asked if he was going to correct the document as we negotiated it, as I would not accept the

Lease Break as it was presented ?



He said "yes it will be corrected back to the original $ 1800.00".



This is kind of like the Mortgage Broker document stories. Whats coming out of their mouths is one thing.

Whats in the contract is what ever they can get away with if your dumb enough to sign it without carfeful review.

IAC Renters READ YOUR DOCUMENTS before signing.



It almost seems that this is acceptable behavior in todays society.



Lets see if he is able to follow up as promised and deliver the documents as negotiated.
 
IAC increased my rent by 2%, i got the lease papers today and i they increased my lease break to 3500, said its company policy now. Any suggestions on reducing this, are there any rules/laws on setting the lease break agreement.



3500 is just too much in todays uncertain environment.

Everything is negotiable. Can't hurt to try. We always negotiated our lease amount down, but we never tried the lease break fee. But it wasn't that crazy amount like it is now.
 
i just got my lease from IAC and the lease break amount is the same as 1 month rent. but the deposit is 600 bucks though. sucks. but then i got the "special" where they take off 200 if you sign up right away and 100 off for doing a direct pay online.
