A 5150 is an involuntary psych hold for up to 72 hours. If this is used to hospitalize him, it means that it doesn't matter whether he agrees or not. Sounds like he may end up having this done.



Make sure and keep in contact with Tustin PD. They need to know if you get any more of those phone calls or if he shows up at your place.
 
Any lawyers on the board? Specifically since he is threatening to take legal action for "leaving him homeless", even though he signed an agreement to release me of liability and terminate the lease.



I spoke to a friend who said to get in touch with a lawyer, since you never know what handicapped people are capable of.



And he also mentioned that courts tend to favor handicapped people and the possibility of society abusing them, so i just wanted to watch my back.
 
Shoob - it doesn't sound like you kicked him to the curb - from what I understand it sounds like you offered him a choice of having his full deposit back with no hassles if he left right then and he chose to take you up on that. He could have declined or bargained with you but he didn't try right? <em>Anybody can sue anyone over anything in this country.</em> He doesn't sound competent enough to follow through and even if he was what's the likelihood he could afford an attorney (he'd probably choose to spend that dough on drugs from the sound of it.) By the way if he was really that bright he would have said he was going to sue you for $7,500 - not $1k like he said - because the former is the max you can sue for in small claims court where you don't need an attorney - anything close to that but over wouldn't be worth the trouble. Also credibility comes into play during any case and I think anyone with two brain cells to rub together could detect his "uniqueness". I'm really sorry you are having to go through this. Next time -- no more Craigslist roomies.
 
Serious I would have never thought he was like this. Just seemed like a quiet shy guy. Those are the warning signs huh?



I learned my lesson. Next time I'm looking for a female roommate....that I know.



I didn't kick him out, I told her I felt extremely uncomfortable returning to my own home, and that I thought it was best that a family member take care of him during this rough patch. She went in and got him to agree to move out.



But then he started rambling about how he didn't appreciate getting kicked out in the middle of the night, I was helping him move his stuff and he was like...you just ruined my bag when I placed an object on top of it. Then he shook my hand and said it was nice living with you. Then the phone calls and the rants and threats.



The mind is such a powerful and unique thing....

Lawyers will usually not give legal advice to someone who isn't their client so I would beware of taking legal advice about the effectiveness of a release provision from anyone on a public forum. You could get your own lawyer, or you could tender the case to your homeowner's insurance company for defense but that could affect your future insurability.

Like your girlfriend will be ok with that - nice try! ;-)



Besides... crazy comes in both flavors.
