Please help me



I am currently work with an agent to purchase a home which I will use all my saving to buy this home.

i make a deposite check to escrow 3000. some how i got an offer and under processing of paperwork. I just received a sign disclosure from the bank and they gave me 5 days of contingency period. they just start to open escrow days. My concern is that. I went to the city and found out that the house which i want to buy has a no permit on one of the addtional room. I worry that in the future the city want me to demolished it. because it is a BUY AS IS. I don't want to spent extra on other cost. Therefore i want to cancell this purchase. I talk with my agent he pursade me not to give up and that i should think about it. Well, i make up mind not to take this home. he told me if i want to cancell i have to sign an agreemetn contract with him that i would not use other agent accept him. Which i think it is non sencse. To be honest he is not trust worhty and that he is giving me a run around at the begining of the process until now, I don't like his service,. Now that he is not willing to help me cancell this home unless i agree to stuck with him forever. that is illegal that he force me to do this. I will lost my deposit



Can some one help me advise what i should do. I need the answer . before i will go to meet with him

Your realtor is probably very hungry, and he definitely does not want you to back out of the transaction that is going to feed his family. The coercion part is pretty ballsy. Personally, I would demand my money back, and I would never speak to this realtor again.
 
I agree with IrvineRenter. Your contract is between you (the buyer) and the seller. The agent is not involved in this contract, therefore, he has no say in this matter.



Drop the realtor.

There are reputable realtors that will put your needs before their own.

I want to drop this realtor. But how I can get me deposit back if he don't want to help me sent a cancellation right form. Can i do it on my own by contact the seller or escrow? Or is there another way?

Your realtor has to file their license with a broker. I would go directly to the office manager. That person will get it resolved immediately. We had a similar problem with our realtor when we sold our house. We tried to work with our agent on one particular problem, but she wouldn't budge. We went to the office manager, and the manager resolved it quickly.

And if he somehow tries to block you then he can threaten to report this realtard to the California Association of Realtors.
 
I forgot to tell you that



That deposited check is now in Broker trust account. That mean it is already withdrawn from my account. I believe the escrow company or listing agent have that money. But i need to send a C.A.R form CR to the seller in order to get my money back.



The problem is i have to go through my agent to get this form send.



so, How am i going to get it back when my agent don't want to cooperate until i signed the agreement to stuclk with this agent forever.?



That mean my 5 days limits will be over and i will lost my money.



huhuuh :-(

For educational purposes, CAR form CR is for contingency removal. A buyer would sign this when they have completely satisfied themselves that they are aware of the property condition and are interested in moving forward with the purchase. Unless otherwise agreed to (sometimes the case in bank sales or auctions), contingencies <u>must be actively removed </u>and can't be passively released without signing them away.

Also purely for educational purposes, CAR form CC is a cancellation of contract form that a buyer or seller (or both) would initiate to express intention to cancel an agreement. You'll note that agent/broker signatures are not required on this form as they are not a party to the agreement between buyer and seller. If the agreement happens to be on a standard CAR Residential Purchase Agreement, the section that speaks specifically to time constraints is paragraph 14.

My advice is that you need to look at homes with some guarantee of performance as opposed to "as is". You do not seem to possess the temperament necessary to deal with an "as is" type of purchase. I am not being mean. With any large purchase or investment, one of the biggest factors to analyze is one's own emotions and to see them with brutal clarity.

His agent will help him? Unless Mr. Happy is lying, his agent is telling Mr. Happy that the agent will only help Mr. Happy if Mr. Happy signs an exclusive agreement with the agent. He does not sound too helpful to me. Am I missing something?

Just say no. And tell him you think it may be best if you work with someone else. It sounds scary and confrontational, but try it. Being polite and honest has a strangely empowering feeling. By the way, most folks here refer to me as "Awgee".

Be warm and friendly. Tell him exactly what you want to do... to withdraw from the process. Tell him you would love to be able to recommend his services to friends and family with confidence, but that you can't do that if he's going to ask you to sign any additional agreement. If he insists you do, go ahead and sign his agreement with the name "Ben Dover" and find yourself another agent (read: IR2).
