It's quite obvious that this legislation will be enacted. I'm sure you already have researched the issue, but for those who haven't, it's being <a href="http://www.govtrack.us/congress/billtext.xpd?bill=h111-676&version=ih&nid=t0:ih:173">bundled into the National Healthcare Act.</a>



From that link:



<em>(1) IN GENERAL- There are appropriated to the USNHC Trust Fund amounts sufficient to carry out this Act from the following sources:



(A) Existing sources of Federal Government revenues for health care.



(B) Increasing personal income taxes on the top 5 percent income earners.



(C) Instituting a modest and progressive excise tax on payroll and self-employment income.

(D) Instituting a small tax on stock and bond transactions.

</strong></em>



While it's clear that this tax will be enacted, what is still unclear is how the IRS will treat deductibility of the transaction tax. IOW, a stock is selling for $10 when you buy it. With the new transaction tax, your true cost is $10.25 a share. Let's say that you sell that stock at $12 a share. The transaction tax will cost you $.30, so effectively you have sold at $11.70 a share.



Will the IRS recognize the short term trade or capital gain as $2 a share (the difference between purchase price and sales price)? Or will they recognize the profit from a short term trade or capital gain as $1.45.



Either way the taxes you pay on that profit are going up.



The only question is how badly you are going to get screwed here.

Let's get back to another point you are dodging. This transaction tax bill has been bundled into a National Healthcare Bill as a method to finance it. (Along with a tax increase for high income earners, and a payroll tax increase for everyone) Given that nationalizing healthcare is a long term liberal goal, how do you explain your insistence that the bill isn't going anywhere.



Clearly this is marching towards becoming law.

How? Because nobody on CNBC is blathering on about it the way you are. While the bill may become law, this particular part won't make it into the final product.
