I was in recently in process to purchase a plan 2 in Stonegate East. On of the major selling points of this plan for me was the California room. The model home has a California room full of furniture and enough space for a small hot tub.

The framing went up recently I decided to see what progress was being made on the home. I was very surprised to find that the house was only 3ft from the cinder block wall.

The sales agents discussed with me at length about how I would get a tub into the small space at the back of the yard. They did not bat an eye lid at me purchasing a $450 hot tub outlet placed in the back right hand corner of the home. Of course they will be covered in the small print of the contract, but that is little consolation for a buyer who was under the impression that they were purchasing something else

I cancelled the purchase shortly after finding this out.

The size of the california rooms in the model homes are radically different from the actual lots.

The lesson from this is buyer beware!!!

I wont be the first to and Im sure I wont be the last to be in for a bit of a surprise in the coming months.

Did they give you exact dimensions of what the california room/side yard was going to be or just aproximations?
 
No exact dimensions. They said that there would be space for a hot tub, hence the $450 for a hot tub outlet.

I remember on the opening day at los altos (SGE), I asked one of the sales person how much smaller would the backyard of the actual homes be compared to the models.  He said maybe just a little bit smaller and about the size of the smallest backyard out of all the models. 

I guess instead of "just a little bit smaller," he should have said a lot smaller or no backyard for the actual homes for purchase...
 
Well the side yard isn't part of the california room so you're still getting the same size california room.  Different lots have different yard sizes and are hence priced differently.  When you picked out your lot you should have checked the yard size before choosing it.
 
When we were buying last year at monterey the sales people were very nice. They had a sheet with
the site plan and would advice correctly on the size of the yard area etc. they would even suggest site plans
per what you told them you were looking for. We even walked the site many times even before it got framed to
measure many sizes.

I have never purchased a new build home before and I did not ask the pertinent questions. I made a very dangerous assumption, that because I was dealing with TIC directly, I had nothing to worry about. However, I think that they have a responsibility to let you know that what you see is not what you get. There is not a plan 2 on the whole site that has the same yard space as the model, it simply does not exist.

If I test drive a BMW five series and it has all the bells and whistles, I know up front that I am going to have to pay for the the extra features. This is also true of purchasing a modern home, you want the upgrades that are not as standard, you need to pay for them yourself. Your not going to pay for the the 5 series and the mats, to find out that they are not going to fit in the one series.

I feel that a this quote from our former President is appropriate.

"There's an old saying in Tennessee ? I know it's in Texas, probably in Tennessee ? that says, fool me once, shame on ? shame on you. Fool me ? you can't get fooled again."
 
The sales manger asked me directly if I would be interested in the model.

I said yes..........for 565K.

Her answer to that was a polite chuckle.  ;)

Just wait they try to sell it for $100,000 under their initial price point for 67 days on the MLS like some 2006-2007 Woodbury homes are now, then chuckle back and offer 10% lower.
 
What method does TIC use to measure sq. feet? Whenever I use the measure tool on the interactive model plan I can never come up with the same sq. feet they claim the model is.

 
To answer your question Bones, they did indeed give me my deposit back, today in fact. In fairness to Pacific Irvine there was no quibble of their behalf. However they had nothing to quibble about.
