Hello,
Hope someone can help me with this issue. I am getting my landscape done by a contractor who had good reviews in TalkIrvine.  I received a "Preliminary notice" from a subcontractor he used to do the work at my home. I talked to the contractor and he says he has already paid the subcontractor. I am not sure what I need to do next. Has anyone had a similar issue? Any advice appreciated.
Thanks.

My understanding is that the Preliminary Notice is filed to just preserve the right to file a lien on the property for work done if he is not paid.  Hence, as long as you pay your contractor and he pays the subcontractor there shouldn't be any problem.  Some subcontractors, as a practice, file the preliminary notice on every project they work on just in case they don't get paid.

Thank you for your response Irvine Dream. I am not sure if I need to respond to the notice. I got a copy of the receipt from my contractor. Wondering if I should call the subcontractor and find out if everything has been resolved between them.

Wouldn't hurt to verify that the contractor has paid his sub.

After many calls to the contractors and subs, there seems to be some confusion and finger pointing about the payments.  I received a notice of Mechanic Lien from the sub couple of days back. Does anyone know of a good Real Estate attorney I can get advice from?
Thanks.

I thought most of these landscapers hired their own guys directly... Are they really booking jobs and hiring to subcontractors?

The lien is from the concrete company that my contractor had used. We were not aware of this until we received the notice.

I looked into this initially as well when I was starting my landscaper interviews and it seems most common with some concrete mix company. For example, check out Robertson?s Ready Mix review on Yelp.

I got a similar notice from some concrete company that was subcontracted by the builder.  Actually half the block on my street all got the same notice.

Looks like these concrete company send out these type of letter routinely.  I just forward the letter to my builder, the mighty TIC.
