So, I know there has been a lot of talk on Calculated Risk about mortgage brokers not having fiduciary duties to their clients, but that is not what my research has revealed - at least not for California. There's a case from the 80's (i.e., Rose Bird court) saying that brokers do have such duties. It's possible that the case has been abrogated by statute, but if so, I couldn't find it. I think I need to become a Plaintiff's lawyer because I'm sure I could find plenty of winning cases.
