A data entry person in my office received notice from her landlord terminating their tenancy. She has been living in the same apartment for almost 9 years. She has 3 kids who are 13, 6 and 2 years of age. I believe her husband is an auto mechanic. Anyway, they live in an apartment in Placentia (I think it's called Pepper tree or something) and now they have less than 30 days to find a place to live. She is absolutely devasted and does not know where they will go. Does ANYONE know of an apartment in the Placentia, Brea, Fullerton area that they can rent right away - which is not too shabby for about 1500 per month? Ideally, they need a 3 bedroom, but they have been managing in a 2 bedroom. Any info for this lady is greatly appreciated.

<p>Did this lady get only 30-notice from landlord? I think she has 60 days, have her call Fair Housing at 714-569-0823 for help. The fastest way is for her to contact a local real estate agent to find her replacement home, no cost to her. Private lease usually much cheaper. Good luck.</p>
 
Thank you nirvinerealtor - I already asked her about that. Apparently, they are on a month to month tenancy and she does not have a copy of her original lease (from 9 years ago). It's my understanding that unless specified in the lease, the landlord can terminate with 30 days notice. But I could be wrong...
 
Civil Code Section 1946.1(b) requires a landlord to give 60 days' notice of termination to a month-to-month tenant who has occupied a dwelling for more than one year. It is not clear from your message when they received the notice, only that they have less than 30 days to find a new place. If the landlord gave less than 60 days' notice, it would appear to violate Section 1946.1(b). Note, however, that there is an exception that provides for notice of not less than 30 days in a case where condo unit is sold. The suggestion to call Fair Housing was a good one--they will be able to walk through the facts with her and give her legal advice.
 
<p>hbunny, have her look into affordable housing in brea. based on her situation (lower income + 3 kids), they might move her to the top of the list. </p>
