Be sure to ask the Realtor for the Northwood II property about NWII's lawsuit vs. TIC Development Co. and find out what impact it may have on future HOA fees (lawyers don't come cheap) and the nature of the claimed defects.
 
I'm not sure it's been discussed before, but it was something I saw in passing. A search of the OC Superior Court website (which is so nested I can't link it, I don't think) shows the following:

Wow, what a messy lawsuit!



Everybody is dragged in to this litigation: developer, builders, civil engineers, landscape architects, landscape contractors and etc except for the architects. I have to assume the issues are site and ground related.



I would not look there knowing the potential ground related issues. It could be defective foundation, slab work, irrigation, drainage and a bunch of ground related issues. I certainly hope land settlement is not in there.



I wonder if the lawyers are soliciting homeowners across the street in Woodbury to file a similar class action lawsuit since they invested enough time on site research?

You are a far more generous soul than I. My first thought was, "Severely underwater on your home? File a CD lawsuit!"



I have no clue as to the issues or merits of the case, but I thought it was interesting that it is taking place in a peak bubble neighborhood. Of course, all the homeowners who signed up now have to disclose it when they sell, causing a greater devaluation, I would think.
