Builder Fiasco - FloorpLan Change after reserving unit

I'm a first time home buyer and wanted to check out if this is happening frequently and if it bothers everyone as much as it is bothering me. I put a reserve deposit on a new home and went into contract a few weeks back. Now the builder is coming back and telling me that the specific unit I reserved has been identified as one of the units that has to be disabled friendly. (One of those 2A & 2ACC differences)

What it means to me that there were be changes in the floor plan, I am loosing one of the closets on first floor because they had to increase the space in the powder room for easy access. I am loosing the only closet on the first floor and also additional storage under the stairs.

After asking a few questions it seems like that this was always the plan just that it was not communicated to me by the sales office. What do you guys think about this and what would you have done?

I am planning on taking it with the head of sales and tell them how incompetent this is. Someone made a mistake, someone did not communicate this to me before I went into contract and now I have to pay for it by losing one of the features of the home that we were hoping to use. Their initial feedback after I voiced my feelings about this was that they can not do anything about it.

Wow... sorry to hear about your situation.

Are they able to give you a similar lot with similar location features for the same price? I would definitely argue for it if they did not disclose these changes prior to going under contract.

Good luck and let us know what happens.

Every building must have one accessable unit and I believe these units are designed as part of the buildings rather than a feature they can randomly add to any unit so techinically, I don't think the bulder is "changing" your floor plan because it probably always was an accessable unit.  If they didn't sell you an accessable unit, they can't force you to accept one, that would be a breach of contract.  I don't see whey the builder would insist on selling an accessable unit to someone who doesn't want one because there are plenty of people who do want such a unit.

Which units are accessible is determined well before the city planning commission even approves the project.  So no one is changing your floor plan.

I do understand that no one is changing the floor plan. It was a plan always in place but it was not communicated to me by the sales team.

I put a deposit on Plan 2A and I am getting 2ACC instead...

They are offering me a different lot, not same size with the original plan 2A. They are being flexible with this but choosing something in the future release would screw up my plans as I would get the home 2-3 months later in that case.

I assume you bought in Santa Barbara.  Do you have the original site plan that you picked from - the one that had the plan 2AC listed as 2A?  That would make your case very strong to get some major concessions with the sales people.  We bought a plan 2AR, and I agree with you - the accessible plan 2AC have you lose counter space in the kitchen as well as the downstairs bathroom storage.
